General Terms and Conditions of Sale
Preamble
These terms and conditions are concluded exclusively between CORNILLEAU SAS, a simplified joint-stock company with a capital of 1,153,800 euros, with its registered office at La Folie – 14 route Nationale – 60120 Bonneuil les Eaux, registered in the Beauvais Trade and Companies Register under number 526 920 194, hereinafter referred to as "CORNILLEAU" or "the Company", and any natural person, non-professional, of legal age and possessing the legal capacity to contract, who visits or makes a purchase via the site nl.cornilleau.com, hereinafter referred to as "the Internet User" or "the Customer".
The parties agree that their relationship shall be governed exclusively by these general terms and conditions of sale, which are accessible on the nl.cornilleau.com website.
These terms and conditions may be subject to change. It is understood that the applicable conditions are those in effect on the site at the time the contract is concluded.
Finally, these general terms and conditions of sale determine the sales procedures between CORNILLEAU and the Internet User. They regulate the various steps to be followed to place an order on this site. The date these General Terms and Conditions of Sale are posted online shall be deemed the effective date.
These General Terms and Conditions of Sale, as well as the preamble which forms an integral part thereof, apply to all sales of products and services provided by our Company. Consequently, placing an order by the Customer implies unconditional acceptance of these terms, which prevail over any other document originating from the Customer, and in particular over all general purchasing conditions.
ARTICLE 1 – CONTRACT
The Internet User declares to be 18 years of age and to have the legal capacity to enter into agreements on our nl.cornilleau.com site and to comply with these general terms and conditions of sale, or to hold parental authorization allowing them to place an order on the nl.cornilleau.com site.
The process of placing an order by the Internet User involves several steps defined below:
- the Internet User completes the identification form on which they provide all requested information or provide their customer number if they have one,
- the Internet User completes their online order form by specifying all references of the chosen products or services,
- the Internet User chooses their delivery method,
- the Internet User chooses their payment method,
- the Internet User confirms their order after checking it,
- the Internet User submits their payment request and carries out this payment,
- the Internet User then receives an order and payment confirmation email from CORNILLEAU, as well as the corresponding invoice.
The order confirmation email signifies CORNILLEAU's acceptance of the Internet User's order and thus constitutes the sales contract between the parties.
The online provision of the credit card number and the final confirmation of the order by the Internet User serve as proof of the completeness of the order. This confirmation serves as a signature and acceptance of all actions performed on the site by the Internet User.
For orders exceeding €150, as well as within the framework of anti-fraud controls aimed at securing customer transactions, CORNILLEAU has the right to request the Internet User to provide, via email or fax, one or more proofs of residence and/or a copy of an identity card before validating their order. The order only becomes final upon receipt of these documents by CORNILLEAU and the sending of the confirmation email. Failure to receive these documents, or if they do not allow the identity and residence of the person placing the order to be established with certainty, CORNILLEAU reserves the right not to accept the order.
CORNILLEAU also reserves the right to check and/or refuse an order if an earlier dispute is pending or if the Internet User's order level is abnormally high.
Unless proven otherwise, the computer records and those of CORNILLEAU's service providers, kept under reasonable security conditions, constitute proof of all transactions carried out between CORNILLEAU and the Internet User.
The Company also archives order forms and invoices on a reliable medium. In accordance with legal provisions, the Internet User may access them by sending a written request to CORNILLEAU, attaching their order form and invoice.
CORNILLEAU advises the Internet User to keep the order and payment confirmation email. CORNILLEAU will subsequently also send an email confirming the shipment of their order.
ARTICLE 2 - THE PRODUCTS
CORNILLEAU strives to describe and present the items sold on the site as accurately as possible. However, certain characteristics of the products may be slightly modified, in particular to improve their quality or safety. Should an error occur despite this, CORNILLEAU can under no circumstances be held liable.
Similarly, product photos published on nl.cornilleau.com are not contractually binding. In no event shall CORNILLEAU be liable based on these photos.
Regarding packaging specifically, all our tables are packed in two different ways:
- individually: each table is packed unassembled in an individual reinforced cardboard box.
- individually assembled: each table is assembled and packed on an individual pallet.
Our spare parts and accessories are packed in such a way that their protection during transport is fully ensured.
ARTICLE 3 - PRICING
All prices displayed on the site are in euros excluding shipping costs and including all applicable taxes in mainland France. VAT is applied at the rate in effect at the time of the order. Any change in the rate will be applied immediately to current orders.
Product prices exclude shipping costs, certain packaging costs, or other optional services subscribed to by the Internet User; these remain additionally due. These will be communicated to the Internet User on the summary screen before the final confirmation of the order.
The amount of shipping costs is stated at the time of order confirmation by the Internet User; this includes:
- administrative processing of the order,
- preparation and shipment of the package(s),
- transport costs.
ARTICLE 4 – AVAILABILITY
Our product and price offers are valid as long as they are visible on the site. The Internet User is therefore invited to consult the availability of items sold on the information page of each product.
Consequently, CORNILLEAU in no way guarantees that products will remain for sale for a certain period. Any complaint from the Internet User regarding the order or delivery of an unavailable item shall be considered unfounded and cannot hold CORNILLEAU liable in any way.
In the event of a validated order where a product or item is no longer available within the periods announced on the site, the entire order will only be processed and shipped when all products of that order are available. CORNILLEAU will then inform the Internet User of this additional period. However, the Internet User may choose to receive the available items of their order as a priority;
If, however, it turns out that this product is permanently unavailable, CORNILLEAU will inform the Internet User of this unavailability. The Internet User must then choose between:
- canceling their entire order: CORNILLEAU will cancel the entire order and undertakes to re-credit the Internet User's account linked to the credit card number provided.
- or receiving the available products ordered: the Internet User is then only liable for the amount of the products shipped, as well as the shipping costs associated with the shipment of these products and the amount of the services they have chosen. CORNILLEAU must partially cancel the order and undertakes to re-credit the Internet User's account linked to the credit card number provided.
In either case, if there is a blockage or any impossibility to re-credit the Customer's account, a check will be sent to them by CORNILLEAU's customer service.
ARTICLE 5 – DELIVERY
Products can be delivered anywhere in mainland France and Corsica, with the exception of delivery to a forwarder. They will be delivered to the delivery address specified by the Internet User when ordering.
For reasons of package tracking, CORNILLEAU reserves the right to refuse orders from individuals to collective addresses such as barracks, military buildings, hospitals, holiday clubs, etc.; this list is not exhaustive.
The delivery times announced on the site apply from receipt by the Internet User of the email confirming the shipment of their order, sent by CORNILLEAU. In accordance with the provisions of Article L216-1 of the French Consumer Code, the delivery date indicated at the time of order constitutes the deadline by which the Company undertakes to deliver the products to the Customer, it being understood that carriers do not deliver on Saturdays, Sundays, or public holidays. Not included in the carrier's performance are: unloading, installation, assembly, delivery to a floor. Additional shipping costs may be requested in case of delivery to islands, high-altitude stations, and generally to places difficult to access by truck.
In case of exceeding the provided delivery time, the Customer is entitled, in accordance with Article L216-2 of the French Consumer Code, to issue a formal notice to the Company by registered letter with acknowledgment of receipt to deliver the ordered products within a reasonable additional period. If the Company still fails to comply, the contract may be terminated by operation of law by the Customer through a new letter to the Company notifying this decision, effective upon receipt of this letter. The amounts paid by the Customer will then be refunded no later than fourteen days after the date of termination of the contract, excluding any compensation or deduction.
The transfer of risks of loss and damage takes place upon delivery to the Customer. In case of unjustified refusal upon delivery of all or part of the ordered goods, CORNILLEAU reserves the right to charge for transport and costs incurred.
In case of irregularities occurring during transport (damaged packaging, missing goods, or damage), it is up to the recipient to:
- make all necessary reservations upon delivery on the delivery note;
- confirm these within three days of receipt of said goods by registered letter with acknowledgment of receipt to the carrier.
- report these to CORNILLEAU within the same period, in accordance with the provisions of Article 8.
The absence of signed reservations upon receipt of the goods by the Customer invalidates any claim.
The procedure as well as CORNILLEAU's contact details are listed on the site. Failure to comply with the reservation or complaint procedure means no complaint can be submitted by the Customer against CORNILLEAU.
ARTICLE 6 – TAKE-BACK OF YOUR OLD EQUIPMENT

The Internet User's bank account will be debited within 48 hours of payment for the amount of the chosen products and services, subject to the value dates applied by banking institutions. CORNILLEAU guarantees the security of bank card payment by using the payment system provided by the company ADYEN for processing payments.
In case of objection to payment or any refusal by the Bank to honor the payment, the order placed by the Internet User will be automatically canceled and the Internet User will be notified by email.
ARTICLE 8 - RIGHT OF WITHDRAWAL
In accordance with the applicable legal provisions, if the Customer is a non-professional natural person, they have a withdrawal period of fourteen (14) days from the delivery of their order to return the product to CORNILLEAU for exchange or refund without penalty, with the exception of return costs.
If the Internet User wishes to exercise their right of withdrawal, it is sufficient to exercise this right by filling out the following form: WITHDRAWAL FORM. CORNILLEAU will then inform them of the procedure to follow to carry out their return.
The Customer wishing to exercise their right of withdrawal must return the products, under the conditions set out in Article 8 below, no later than 14 days after the date of sending their notice of withdrawal to the Company's address.
CORNILLEAU will refund the Internet User by any means for the price of the product and the costs of the original shipment within a maximum period of 8 days from receipt of the package, provided that the product is returned complete, in perfect condition, and in its original packaging.
In case of a partial return of the order, CORNILLEAU will refund the Customer the shipping costs in proportion to the total amount of the order.
In case of a full return of the order, CORNILLEAU will refund the Customer the total amount of the shipping costs paid with the order.
All return shipping costs of the product to CORNILLEAU, as well as all costs and risks associated with this return, remain the responsibility of the Customer.
If, however, a problem arises regarding the Customer's collection of the delivered order, in particular a problem with the delivery address provided by them resulting in a return to CORNILLEAU, CORNILLEAU will contact them to confirm the reshipment of the order. From then on:
- failure of the Customer to respond within 15 days of this reminder, CORNILLEAU will assume that they have exercised their right of withdrawal for this order;
- in case of a positive response for reshipment within this fifteen-day period, CORNILLEAU reserves the right to charge the Customer for the shipping costs of this new shipment.
ARTICLE 9 – RETURNS
With the exception of the right of withdrawal mentioned in Article 7, the Internet User can only return their product for the following reasons: item not satisfactory because it does not correspond to the order, missing item, defective or damaged during transport.
The Internet User must compulsorily check the condition of the package and the products in the package upon delivery and make all necessary reservations on the delivery note, according to the procedure described in Article 5. Failing this, no claim can be made by the Internet User against CORNILLEAU.
The Internet User has three days after receipt of the package to notify CORNILLEAU of their claim by logging into their order via the contact area of the site. CORNILLEAU will then inform them of the procedure to follow to carry out their return.
The Internet User must also attach a duplicate of the documents relating to the defective delivery (delivery note, reservations, order number) to their return package to enable the processing of their claim.
The Internet User is requested to contact CORNILLEAU's customer service within the same three-day period. The customer service may then, if applicable:
- cover the costs necessary for the return of the product.
- assist the Internet User in exchanging the product or placing a new order for a compliant product and organize its shipment at its expense, subject to availability in stock of the requested product.
If the ordered product is no longer available on the date of return, CORNILLEAU will refund the missing product and the initial shipping costs in proportion to the overall order.
If the return is not validated by CORNILLEAU, in particular if the reservations are not stated on the delivery note and if a copy thereof is not attached to the return, this return will be considered non-compliant and treated as such.
The Customer is responsible for the method of packaging their product; this must be carried out in such a way that the product can travel without risk of breakage or damage. In general, all risks associated with returning the product are the responsibility of the sender. Indeed, the Customer remains free to choose their method of sending the returned order and whether or not to take out any insurance, particularly in case of theft, loss, or destruction of the package. In no event shall CORNILLEAU be liable for failure to receive the package sent by the Customer.
Only products returned complete, in perfect condition, and in their original packaging will be accepted. Otherwise, the return will be considered non-compliant and treated as provided in Article 10 of these General Terms and Conditions of Sale.
